Judge rules California's decades-old assault weapon ban violates Second Amendment

During the last several decades, Californians have lived through a series of legislative laws and propositions that have repeatedly restricted and banned our 2nd Amendment Civil Rights.  Some of these restrictions include background checks to obtain ammunition, excessive 10-day waiting periods to pick up a gun, limits on rifle and pistol magazines to ‘no more than 10 rounds’, limits to purchasing just one pistol a month and strict regulations on sporting rifles that fearful liberals call ‘assault weapons’.

Pro-2A groups and gun owners have successfully challenged several of these draconian laws in Federal Court.  Several years ago, Federal Trial Court Judge Roger Benitez stated California’s ’10-round magazine ban’ was unconstitutional and his opinion was recently upheld by a 3 judge panel on the 9th Circuit Court of Appeals.  That case is pending a ‘full review’ of the 9th Circuit’s full panel of judges.  

Earlier this year, Judge Benitez heard another a case related to the 3-decade-old assault weapon ban.  Last week, Judge Benitez stated the assault weapon ban was unconstitutional as well.  Currently, the case is ‘on hold’ pending a likely appeal by the State of California, but it’s a move in the right direction!

We support the 2nd Amendment of the U.S. Constitution and applaud Judge Benitez’ strong defense of our individual God Given rights and liberties.
